Bishop Records in Surry County, Virginia (After 1700)

There are no mentions of Bishops between 1700 and 1716.  The records below relate to Bishops who moved into Surry County from Prince George (formerly Charles City) County.

  • Some records of no genealogical value are omitted.

15 August 1716
At a court held at Southwarke:  “In the Accon. [read “action”] of Debt Between John Tyus Plt. and Henry Bishop Deft. for two hundred and fifty six pounds of Tobo, the Deft. being Called and not appearing nor any Security returned for him at the mocon of the Plt. Judgmt. is granted him agt. Jno. Simmons Sherif of ye County for ye sd Sum & Costs unless the Deft. Appears at the next Court & Anser the sd. Action…  On the motion of John Simmons an Attachment is Granted him agt. the Estate of the said Henry Bishop for the aforesaid sum…” [Surry County, Virginia Order Book 1713- 1718, p90-91.]

Defendants had to be sued in their county of residence, so either Henry Bishop is living in Surry County or the plaintiff and the members of the court think he is.

19 September 1716
At a court held at Southwarke:  “In the Action of Case Between John Tyus Plt. and Henry Bishop Deft., neither party appearing it is Ordered that the same be Dismt. [Surry County, Virginia Order Book 1713- 1718, p92.]

At a court held at Southwarke:  “In the Action of Debt Between John Tyus Assignee of Robert Nicholson Plt. and Henry Bishop Deft., neither part(y) Appearing it is Ordered that the Same be Dismt. [Surry County, Virginia Order Book 1713- 1718, p93.]

Chancery court records no longer exist for the period.  Chancery cases involve disputes involving fairness, or equity, rather than strict interpretation of the laws.

16 January 1716/7
At a court held at Southwarke:  “In the Suit in Chancery Between Henry Bishop Complt. and Richard Atkison Deft. neither party appearing it is Ordered that the same be Dismist.”  [Surry County, Virginia Order Book 1713- 1718, p103.]

No separate Chancery Court records survive for this period, so this case is a mystery.

17 January 1717/8
At a court held at Southwarke:  “In the action of debt between Abraham Heath Plt. &  Henry Bishop Deft. deither party Appearing it is Ordered that the same be dismist.”  [Surry County, Virginia Order Book 1713- 1718, p130.]


There is a 23-year gap in Surry County court records.  The Order Books from late 1718 to late 1741 are lost.  Court records resume with the court held on 26 December 1741.

Deed: William Merriott of Southwarke parish to Abraham Faulcon, Jacob Faulcon and Nicholas Faulson of the same, for ___, 343 acres in Southwarke parish bounded by Mr. John Bishop, the Reedy Swamp and Mr. Edwards… being a patent of Mr. Thomas Binns of 25 February 1653… [Surry County, Virginia, Deeds Wills Etc. This is a very old description, referring to the John Bishop of Surry County who is long dead.  This often happens when the description of the land is based on old surveys

Inventory of estate of John Barker dec’d presented by James Bishop.  Presented in court on 15 Octrober 1740 by “James Bishop & Mary his wife Execut’x of the last will and testament of the said deceased.”   Appraised at £11:15:0 by Thomas Bedingfield, Rich’d Blunt and Edm’d Ruffin. [Surry County, Virginia Deeds & Wills Book 9 (1738-1754), p226.]

James Bishop has apparently married the widow of John Barker.  This is one of the items omitted by Hopkins in his book of Deeds & Estate Accounts 1734-1755.

Will of Grace Barker of Southwark parish: “…to my brother Josiah Barker what he hath in his possession… to my cousin Richard Barker my plantation with three hundred acres of land more or less provided he shall let his brother John Barker have a hundred acres of this said land when he comes of age…  to my cousin Josiah Barker one iron kettle… to my cousin Mary Bishop one gold ring posy{?) is no change till death provided she has a daughter & if not to return to Elizabeth Barker daughter of Josiah…  to my three cousins WIlliam, Joshua and Joel Barker 5 shillings credit in a store apiece… to Mary Bishop’s son James one pewter dish… to Faith Barker one small trunk… to Elizabeth Barker one trunk & a loom & what belongs to it… constitute & ordain Richard Barker my sole & only Executor….”  Signed: Grance Barker. Deed: Benjamin Jones and Constance his wife, and Joseph Carter Junr. and Elizabeth his wife, all of Martins Brandon parish in Prince George County to WIlliam Bishop of Albemarle parish in Surry County, for £5 current money of Virginia paid to Jones and £5 paid to Carter, sell their interest in 240 acres lying on the south side of the Nottoway River in Albemarel parish of Surry County…. beginning at a black oak a corner tree of Lambert Zells… a line tree of Catherine Evans…  which said land was granted to Henry Pebles, father of the said Constance Jones and the sd. Elizabeth Carter by pattent dated 25 August 1731… and which the said Henry Pebles died possessed of and which descended to the said Constance Jones and Elizabeth Carter and Agnis Zells and Lucy Zells and Amy Bishop and Rebecca Pebles daughters and coheirs  of the sd. Yet another abstracting error — Hopins wrote the witness as “David” Jones, but it clearly reads “Richard Jones”.

16 March 1742/3
Court:  On the motion of Sarah Jones, widow of James Jones, who renounced his will and claimed her widow’s thirds, the court appointed James Chappel, Howell Briggs, Moses Johnson & John Mason to assign to her one-third of her husband’s land and slaves  in Surry County and Mason Bishop, William McClain, James Parish and John Hogwood were appointed to divide one-third of the personal estate…   the following month the court clarified that they ere to divide the personal estate located in Brunswick County…  .  [Surry County, Virginia Order Book 1741- 1744, p110 and p115.]

Court:  Thomas Hyum of London, Merchant, Plt. against Jeremiah Bishop Defendant, on a Petitioon for £3:11:7 halfpenny sd. to be due by account… the Deft. having been duly Served… and Summoned…and not appearing…” judgment for the plaintiff.  Writ issued 28 May 1744. Deed: John Warrick to Jeremy Bishop, both of Surry C ounty, for £2:15:0 current money of Virginia, 155 acres in Southwark parish… beginning at the mouth of Betteys Spring branch, running up the said branch to the head to a red oak a corner tree & from thence along Mr. SHort’s line across the head of Warricks Swamp to a scrub white oak a corner tree & from thence down Vall. Deed:  Jeremy Bishop & Mary Bishop his wife of Surry County to William Adams of Prince George County, for  £11:2:0 current money of Virginia, 155 acres in Southwark parish…  (the sale land as above). Court:  Ordered that Nicholas Edmunds, John Ogburn, Mason Bishop and James Parish, or any three of them, appraise the slaves and personal estate of William Briggs dec’d”that lie in Brunswick County” [Surry County, Virginia Order Book 1744-1749, p453.]

16 May 1749
“Ordered that William Dancey be appointed Surveyor of the Road whereof WIlliam Bishop was, who is discharged from that office.” [Surry County, Virginia Order Book 1744-1749, p544.]

21 November 1749
Suit: William Goodright vs. James Badtitle, In ejectment for a plantatioon in Southwarke parish of ten acres arable land with one messuage and 120 acres of woodland… in the demise of William Barker.. it appearing by the affidavit of Benjamin Briggs that James Bishop, tenant in possession of the premises, hath been duly served with a copy of the pllt’s declaration… and he not appearing ord’d (to) appear at the next court… [Surry County, Virginia Order Book 1749-1751, p37.]

James Bishop thinks he has a valid lease to the land. But he acquires land a few months later.

James Bishop is apparently on his new land, so no need to eject him from the leased property.

“Ordered that Mason Bishop, James Parish, Nicholas Lanier and John Matthews… beign first sworn before a justice of Brunswick County do appraise in current money the slaves and personal estate of Sarah Jones deceased in that County…” [Surry County, Virginia Order Book 1751-1753, p9.]

The apprasisers had been appointed in court on 19 December, so this was quick work.

At a court held for Surry County:  Ordered that John Bishop be exempted from paying County and Publick levies. [Surry County, Virginia, Order Book 1751-1753, p371.]

Some were exempted due to office but this appears to be related to age or infirmity. This is surely the John Bishop of the 1757 will.

Will of Mason Bishop of Southwark parish, Surry County:  …I desire that my beloved wife Ann Bishop may have the use of the plantation whereon I now live during her natural life, also the use of my negro woman Moll, all my household and kitchen furniture & plantation utensils during her natural life.  also give her five hundred pounds current money.    Item: after the death of my said wife, I give my lands to be equally divided between my two sons Henry Bishop and Mason Bishop (in such a manner that the house etc. may be taken on my son Mason‘s half of the land)… Item: after the death of my said wife, I give my negro woman Moll and her future increase unto my daughter Rebekah Bishop… also all my household and kitchen furniture unto my said daughter Rebecca(sic) . Item:  I give to my son William Bishop two thousand pounds current money of Virginia to be put to interest till he becomes of age. Item: I desire that when my son Mason Bishop comes to the age of twelve years, all my other negroes and what money may be due to my estate may be equally divided amongst all my children… Lastly I constitute and appoint my brother Joshua Bishop and Captain Lemuel Cocke executors…  Signed: Mason Bishop. “On the motion of Thomas Bishop heis appointed guardian to his son Moses Bishop for a legacy left him by John Johnson deceased., the sd. Thomas thereupon entered into and acknowledged a bond with approved security conditioned for securing the said legacy and indemnifying the court.”  [Surry County, Virginia Court Order Book 1775-1785, p196.]

It is worth emphasizing that the role of a guardian was to manage the minor’s possessions rather than his person.  The guardian was responsible for preserving a minor’s estate and delivering it when the minor reached majority.

A secondary source lists the bondsman as Sarah Cheatham, but the original marriage bond shows the bondsman as Arthur Moody.  Elizabeth was probably the daughter ” named in the 30 March 1788 will of John Cheatham, which was witnessed by Arthur Moody.

Bill of Complaint in Chancery:  Wyatt Bishop & Augustin Bishop vs. Thomas Bishop…  Harmon Bishop the father of the compl’tes departed this life having first made & ____ his last will and testament… a certain. Thomas Bishop duly qualified as Ex’r, after payment of his debts & a small legacy of ten percent to all the rest & residue of the estate…   The Court appointed a commission to allot the estate of 10 slaves, into three equal portions.   On 20 June 1816 the commissioners reported a division and the matter was settled.
